Who May Use the Services

You may use the Services only if you agree to form a binding contract with Cyclekits.ng. In any case, you must be female (of the sex that can bear offspring or produce eggs, distinguished biologically by the production of gametes (ova) that can be fertilized by male gametes) to use this service. If you are accepting these Terms and using the Services on behalf of your daughter, sister, niece, aunty, mother or other female relative and or friend, you represent and warrant that you are authorized to do so and have the authority to bind the person to these Terms, in which case the words “you” and “your” as used in these Terms shall refer to the person. We strongly recommend that a minor (person under the age of 18) should only access this service with the direction of a guardian.

The Services We Provide

Our mission is to enhance menstrual hygiene management, promote and improve access to female genital care. To help advance this mission, we provide the Products and services described below to you:

  1. Track your period: By giving us the dates of your last menstrual days, the APP is programmed to calculate your cycle days to know your next menstrual days so the company can make available to you at your door step the necessary menstrual kits needed for proper menstrual hygiene management few days prior to your period. Please take note that the APP may not be accurate with its calculation of your next menstrual days as the cycle days varies among women and may change time to time for some biological or medical reason. We implore you to always update your information and provide us with the accurate data at all time so as to serve you better.
  2. Introduce you to licensed medical practitioners and products: We understand that genital related topics are very important, sensitive and intimate to women. It is important that every woman has easy access to consult on the appropriate product, services and exercise to take care of their feminine and genital hygiene. With the use of Chat in the APP, you will be able to make inquiry about your feminine concern from a live representative with medical background/training, learn about appropriate licensed products for your intimate care, get information on the best medical practice that may be of help to you or a recommendation to a licensed medical practitioner.
  3. Provide you with relevant health care information: Information is key, especially in regards to human health. In the home page of your app, you will be able to get relevant news and articles about women health, professional medical advice, self care or home remedies and all kinds of health care products.

Privacy

To use the App, you may be required to create or update an account (“Account”) and will be asked to provide certain personal information, which may include your name, birth date, physical address and phone number. This information will be held and used in accordance with our privacy policy, which can be found at cyclekits.ng/privacy-policy (“Privacy Policy”). You agree that you will supply accurate and complete information to the Company, and that you will update that information promptly after it changes.

Use by Minors Disclaimer

The information within the APP does not incite, induce or otherwise promote any sexual behavior or activity among minors and does not direct the content of communication to any particular person. All information provided within the App is for general educational purposes only.

We fully understand that moral and ethical rules might differ from state to state and country to country in defining what information related to sexuality is accessible to minors.

We neither intend nor publish sexually explicit content, or content that otherwise might qualify as harmful to minors or juveniles under applicable law. We make reasonable efforts to ensure that all materials provided by us on the App are based on facts only and are scientifically accurate. Please be aware that individual ethical views on what is offensive or harmful to minors may vary from the requirements set for content that may be made available to minors under applicable law.

Medical Services Disclaimer

The company is not a licensed medical care provider and the APP is not intended to replace professional medical advice or diagnose, treat or manage any illness or gynecological problems and conditions. Please consult with a licensed gynecologist or other qualified healthcare provider either introduced by us or by any trusted person or entity before making any decisions or taking any actions that may affect your health and safety or that of your family or fetus. Never disregard professional medical advice or delay in seeking it because of something you have read in connection with the APP. If you think you have a medical emergency, call emergency services or go to the nearest open medical emergency center immediately.

We disclaim liability for any errors or omissions, or for the unintended technical inaccuracies, or typographical errors in any materials provided on our APP or by any of our customer service representatives. We as well disclaim any violation of any ethical or moral standards applicable in your community to sexual education and related materials. Nothing in this agreement excludes or limits in any way our liability to you where it would be unlawful to do so.

Warranty Disclaimer

The Company controls and operates the App from various locations and makes no representation that the App is appropriate or available for use in all locations. The App or certain features of it may not be available in your location or may vary across locations. Neither the company, nor any of its officers, directors, employees, agents, affiliates, representatives, suppliers, partners, advertisers or content providers warrants, and each of them hereby expressly disclaims, that; (a) The app will be secure or available at any particular time or location; (b) Any content or software available at or through the app is free of viruses or other harmful components; (c) The result of using the APP will completely meet your requirements. OR (d) The accuracy, reliability, or completeness of the content, text, images, software, graphics, or communications provided by third parties on or through the app.

Third-Party Services and Links

To meet some obligations, we may contract or involve a third party service, i.e logistic company. You should know that we do not have any control over the third party operation. We will solicit on your behalf for the best of service but we disclaim any liability that rises from any error or disappointment by the third party on the course of completing their task.

The App may give you access to links to third-party websites, apps, or other products or services. The Company does not control Third Party Services in any manner and, accordingly, the Company is not responsible for the privacy practices of such Third Party Services and does not assume any liability associated with such Third Party Services. The Company's inclusion of links to Third Party Services is only an introduction and does not imply any endorsement of any kind by the Company of the material located on or linked to by such Third Party Services and should not be deemed as such by any user of the App. The Company disclaims any responsibility for the products or services offered or the information contained on any Third Party Services. You need to take appropriate steps to determine whether accessing a Third Party Service is appropriate, including protecting your personal information and privacy in using any such Third Party Services and complying with relevant agreements.

You shall not link to our websites, app, content or services in a way that is: (i) illegal, (ii) suggests any form of association, approval or endorsement with or by us where none exists, (iii) damages our reputation or takes advantage of it, or (iv) is unfair.

Changes to the App

From time to time and without prior notice to you, we may change, expand, and improve the App. We may cease any features within the Services to you or to users generally. We also retain the right to create limits on use and storage at our sole discretion at any time. We may also suspend or terminate users at our discretion. Any modification or elimination of the App or any particular features will be done in our sole and absolute discretion and without an ongoing obligation or liability to you.

Indemnity

You agree to defend, indemnify, and hold the Company, its officers, directors, employees, agents, affiliates, representatives, licensors, suppliers, partners, advertisers and content providers, harmless from and against any claims, actions, demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, arising out of or resulting from, or alleged to result from, your violation of this Agreement.

Term of Use

You agree that if you take any of the following actions, you will be materially breaching this Agreement, and you agree that you SHALL NOT:

  1. Resell, rent, lease, loan, sublicense, distribute, or otherwise transfer rights to the App;
  2. Modify, reverse engineer, decompile or disassemble the App;
  3. Copy, adapt, alter, modify, translate, or create derivative works of the App without the written authorization of the Company;
  4. Permit other individuals to use the App, including but not limited to shared use via a network connection, except under the terms of this Agreement;
  5. Circumvent or disable any technological features or measures in the App for protection of intellectual property rights;
  6. Use the App in an attempt to, or in conjunction with, any device, program, or service designed to circumvent technological measures employed to control access to, or the rights in, a content file or other work protected by the copyright laws of any jurisdiction;
  7. Use or access the App to compile data in a manner that is used or usable by a competitive product or service;
  8. Use your Account to advertise, solicit, or transmit any commercial advertisements, including chain letters, junk e-mail or repetitive messages to anyone;
  9. Use your Account to engage in any illegal conduct;
  10. Upload or transmit any communications that infringe or violate the rights of our representatives or any party;
  11. Upload media of any kind that contain expressions of hate, abuse, offensive images or conduct, obscenity, pornography, sexually explicit or any material that could give rise to any civil or criminal liability under applicable law or regulations or that otherwise may be in conflict with this Agreement, and the Company’s Privacy Policy; or
  12. Upload any material that contains software viruses or any other computer code, files or programs that is malicious, technologically harmful or designed to interrupt, destroy or limit the functionality of any computer software, this website or the App.

Any such forbidden use shall immediately terminate your license to use the App.

Passwords

You are responsible for taking all reasonable steps to ensure that no unauthorized person shall have access to your App passwords or account. It is your sole responsibility to:

  1. Control the dissemination and use of your phone number and passwords;
  2. Authorize, monitor, and control access to and use of your App account and password;
  3. Promptly inform the Company if you believe your account or password has been compromised or if there is any other reason you need to deactivate a password. Send us an email at [email protected]. You grant the Company and all other persons or entities involved in the operation of the App the right to transmit, monitor, retrieve, store, and use your information in connection with the operation of the App;
  4. Acknowledge and agree that the App and account are designed and intended for personal use on an individual basis and you should not share your account and/or password details with another individual. The Company cannot and does not assume any responsibility or liability for any information you submit, or your or third parties’ use or misuse of information transmitted or received arising from using the App, and shall not be responsible for any losses arising out of the unauthorized use of your account or information resulting from you not following these rules.

Your Feedback

We welcome your feedback about the App. Unless otherwise expressly declared, any communications you send to us or publish in app stores are deemed to be submitted on a non-confidential basis. You agree that we may decide to publicize such contents at our own discretion. You agree to authorize us to make use of such contents for free, and revise, modify, adjust and change its contextually, or make any other changes, in each case as we deem appropriate.

Notice and Takedown Procedures

If you believe any materials accessible on or from the App infringe your copyright, you may request removal of those materials (or access thereto) from this App by contacting the Company and providing the following information:

  1. Identification of the copyrighted work that you believe to be infringed. Please describe the work, and, where possible, include a copy or the location of an authorized version of the work;
  2. Identification of the material that you believe to be infringing and its location. Please describe the material, and provide us with its URL or any other pertinent information that will allow us to locate the material;
  3. Your name, address, telephone number and (if available) e-mail address;
  4. A statement that you have a good faith belief that the complained use of the materials is not authorized by the copyright owner, its agent, or the law;
  5. A statement that the information you have supplied is accurate, and indicating that “under penalty of perjury,” you are the copyright owner or are authorized to act on the copyright owner’s behalf;
  6. A signature or the electronic equivalent from the copyright holder or authorized representative.

In an effort to protect the rights of copyright owners, the Company maintains a policy for the termination, in appropriate circumstances, of subscribers and account holders of the App who are repeat infringers.

Menstrual hygiene materials are those used to catch menstrual flow, such as cloths, reusable and disposable pads, menstrual cups and tampons. Menstrual supplies are other supportive items for menstrual hygiene and health more broadly, such as soap, underwear and pain relief.
